Lead, Contracts

Job Description:

Reporting to the Manager, Contracts, the Lead, Contracts will be responsible for management of the contracts team within the Project Development Group to ensure all projects are performed to an industry-leading standard through the full lifecycle of Contracts Management activities for Teck projects.

 

The Lead, Contracts is responsible for ensuring quality and consistency of contracting across projects including contract strategy development (including the identification of compensation and market approach models), developing detailed contract risk registers (including the development and implementation of prevention and mitigation strategies) planning and completing request for proposal (RFP) processes, evaluating proposals and negotiating agreements, making recommendations for award, conforming contracts for execution, administering (including assessment of payment and commercial claims), and closing contracts. Close liaison and coordination with the various Contract Specialists within the PDG contracts team as well as project managers, and Project Development Group senior leadership, and corporate shared service groups (legal, risk, customs and trade compliance, etc.) is required.

 

The Lead, Contracts will work in an inter-dependent manner with internal and external lawyers, contracts and procurement professionals, other PDG Leads, and a diverse group of Teck employees, external service providers and contractors in Canada, the USA, Mexico and Chile to ensure Teck’s contracts effectively define and handle the legal, commercial, and technical obligations and objectives of the parties involved so as to protect and advance Teck’s interests.

Responsibilities:

  • Maintaining and demonstrating Teck’s commitment to safety and environmental protection as a core value.
  • Demonstrating Teck’s respect for the rights, cultures, interests, and aspirations of Indigenous Peoples
  • Ensuring all capital Projects have adequately skilled contracts resources assigned as required by level of work and need by Project Managers/Directors.
  • Coordinating a program of recruitment and retention of contracts professionals in support of current and future project demand
  • Mentoring and training all Contracts team members and ensuring adequate exposure to grow skills, and addressing any areas of concern in performance of contracts team members.
  • Developing and recommending Program and Project Contracting Strategies to Project Directors and the Vice President, Project Development for multi package contracting scopes.
  • Facilitating and guiding contract strategies and contract plans to Project Managers, ensuring contract strategies consider appropriate legal, commercial, and technical approach to scope packaging, bidding, awarding, managing, and closing contracts.
  • Conducting project reviews and stage gate reviews to confirm completeness of contracts set up and identify areas of concern/risk.
  • Identifying and leading new initiatives within the contracts team in order to ensure continuous improvement on contracts performance.
  • Participating in annual budget preparation for the contracts function.
  • Handling the request for proposal process, when required including:
  • Planning, preparation, and management of the RFP documents and process
  • Analyzing and evaluating of commercial proposals
  • Undertaking commercial risk assessment on technical documentation forming part of the RFP and contract suite
  • Handling the technical evaluation process
  • Negotiating commercial and legal terms on behalf of Teck, including drafting recommended amendments to the legal conditions for approval by corporate counsel
  • Recommending award based on overall best value
  • Conforming, executing, and awarding resulting contracts
  • Ensuring all records are handled and retained
  • Coordinating agreements (post-award) including evaluating pre-mobilization deliverables, balancing invoices, negotiating / resolving disputes, negotiating changes, implementing change management procedures, and closing contracts.
  • Proactively providing leadership to Project Managers and project teams in regards to contract management strategies, options, and considerations throughout all stages of contracts lifecycles.
  • Interpreting legal and commercial terms and relying on those terms to manage contractors, advise Project Managers and project teams, and to resolve disputes / claims.
  • Implementing effective change management to ensure contract modifications are accurately documented and approved.
  • Ensuring contracts are closed out appropriately and in accordance with applicable legislation.
  • On a project, handling and instructing the EPCM in its execution of full contracting lifecycle on behalf of Teck.
  • Develop, for Management approval, contracts management policies, procedures, and templates for the Project Development group.
  • Supervising Contractor performance in respect of their Contracts with Teck and leads Contractor steering activities
  • Coordinating a program of commercial claims mitigation and management
  • Proactively resolving issues that arise between contractors and project teams in a professional manner.
  • Preparing ad hoc contract management reports as the need arises and present to PDG senior leadership on contracts-related matters.
  • Adhering to all corporate policies, code of ethics and codes of conduct.
  • Performing job-related administrative duties as the need arises.

Qualifications:

  • Post secondary education from a recognized institution is required.
  • 10+ years of experience in an engineering, procurement and construction (EPC) or an engineering, procurement and construction management (EPCM) company or owners project team and managing and completing contract lifecycle activities.
  • Strong understanding and experience with project lifecycles, project procedures, project roles and responsibilities.
  • Sophisticated understanding of the unique-requirements for performance of the Contracts and Management role in an Owner’s team, in addition to proven dedication within an EPCM, EPCM, or Tier 1 Contractor organization.
  • Outstanding leadership skills, and a proven track record of developing hard-working teams
  • Demonstrated experience at facilitating multi-person working sessions and developing integrated business processes
  • Able to independently develop and recommend sophisticated project contracting strategies.
  • Sophisticated understanding and experience with various contract types, models, strategies.
  • Strong understanding of various legal and commercial terms and ability to interpret, defend, apply, and rely on those terms.
  • Strong negotiation and dispute resolution skills.
  • Able to raise awareness of contract activities which have an impact to a project.
  • Excellent critical and conceptual thinking skills.
  • Excellent interpersonal skills as well as strong written and verbal communication skills.
  • Proficient in Microsoft Word, PowerPoint, Excel, Outlook and Internet Explorer.
